Another tragedy happened last week. February 12, 2022 in Orenburg, stray dogs attacked a 13-year-old girl in Orenburg. The child survived, but was injured. The Investigative Committee of the Russian Federation believes that the incident occurred due to the negligence of the housing and communal services of the city administration.

The situation with stray animals has recently worsened in many parts of the country, including Kolyma. In this regard, the state of emergency was in force in Magadan from January 27 to February 2. 

Former Chairman of the State Duma < strong>Vyacheslav Volodinstressed the importance of the responsibility of local authorities in the situation of stray dogs, since there are specialized companies that must catch the animals and take them to shelters. “No Shelter&rdash; building shelters, interacting with those who deal with these issues,” Volodin underlined.

How do they want to punish Russian officials for attacking people with dogs?

For stray dog ​​attacks, Russian officials are being offered fines of up to 200,000 rubles. At the same time, if the animal attack caused serious harm to a person's health or death, then criminal liability will be provided.

“We propose to increase liability for violation of law in the field of animal treatment for officials and citizens. Amendments are made to the Code of Administrative Violations. For officials, fines will be up to 200,000 rubles. We are talking about cases where there is no criminal corpus delicti, if the attack of stray dogs did not cause casualties. If there are victims, this is already criminal liability, », — Vladimir Burmatov said.

Burmatov did not specify what time frame it was. 

How do MPs plan to punish owners whose dogs attack people?

According to Burmatov, for dog owners who allowed their pets to attack and bite a person, involves a fine of up to 200 thousand rubles.

“It turns out that the latest bite stories involve dogs that have owners and are not homeless. I emphasize that this penalty applies for minor harm, », — Burmatov added.

Recall that Law No. 498-FZ of December 27, 2018 “On responsible treatment of animals” is in force in the Russian Federation. The document states that placing dogs on people is not permitted except in self-defense.

However, the Code of Administrative Offenses of the Russian Federation does not provide for a fine for the owner of the animal. Relevant documents can only be adopted at the regional level. Thus, in Moscow for “placing a pet on people or animals”; can be held administratively responsible. Local law establishes the following fines:

  • for officials — from five thousand to ten thousand rubles.

If the owner of the dog deliberately places the dog on another person, as a result of which he suffered, he faces:

  • up to eight years in prison for loss of vision, hearing , loss of any other organs, inability to acquire, mental disorders, termination of pregnancy (Article 111 of the Criminal Code of the Russian Federation “Intentional harm to health”));
  • up to three years, if the victim received injuries that are not life-threatening, but resulted in long-term treatment, disability (Article 112 of the Criminal Code of the Russian Federation “Deliberately inflicting moderate damage to health”);
  • up to four months of arrest, corrective work up to 1 year or a fine of up to 40,000 rubles for causing minor bodily harm ( article 115 of the Criminal Code of the Russian Federation “Intentional infliction of minor harm”).

If the court determines that causing serious harm to health was due to negligence (Article 118 of the Criminal Code of the Russian Federation”Causing serious harm through negligence”), then the owner of the dog faces :

  • a fine of up to 80,000 rubles or the amount of the convicted person's income for six months;
  • or compulsory labor up to 480 hours;
  • or correctional labor up to up to two years

  • either restriction of liberty for up to three years;
  • or arrest for up to six months.

According to Burmatov, it is proposed to allow regions to keep animals in shelters for life. In addition, the parliamentarian believes that the constituent entities of the Russian Federation should have the right to set fines themselves for animals that walk alone.

“The constituent entities of the Russian Federation demand additional powers in terms of regulating the number of stray animals. We would be of the opinion that it would be right to give them a number of powers. For example, establishing a ban on self-walking animals so regions can introduce additional requirements for keeping pets,” — Burmatov said.
