Do I have to pay mortgages and loans during the introduction of the state of emergency?

During the period of the special regime, citizens must continue to pay loans and mortgages. In accordance with the law, federal or regional authorities may, at their discretion, provide one-time material assistance to their citizens. But no matter how bad a family's financial situation is, debts on a loan or mortgage still need to be paid off.

Can the debts be restructured?

The Borrower can qualify the emergency as force majeure in order to reduce the amount of bank penalties or 39; be exonerated in court. At the same time, the restructuring of the debt depends entirely on the decision of the credit institution. 

The borrower can agree with their bank to modify the agreement: for example, reduce the interest rate or increase the term of the loan by reducing the monthly payment amount. < /p>

For the bank to make a decision and complete the restructuring process, you will need:

  • documents confirming that the debtor has a difficult financial situation (certificate confirming the temporary incapacity of the payer, a copy of the work book, which contains reduction/dismissal records, documents on the need to pay, for example, sudden medical expenses or equipment repair which is a means of income);
  • application;
  • passport;
  • loan agreement;
  • refund amount information.

The Bank of Russia notes that the Central Bank recommends lenders to restructure loans to affected individuals and businesses, taking into account an assessment of specific circumstances. A request can be made indicating the relevant reason (urgency) and attaching the supporting documents. However, these are the recommendations of the Central Bank, and there is no law yet to cancel the debts. Last year MPs proposed amendments that would allow debt restructuring. According to Izvestia, the bill was titled “Amendments to some legislative acts of the Russian Federation (concerning the restructuring of credit debt of borrowing citizens affected by a natural or man-made emergency)”.  

It is proposed to supplement the legislation with new rules allowing the revision of the terms of loan agreements (including mortgages) and loan agreements (including the cancellation of the debt), if the borrower is affected by a natural or man-made emergency.

To change the terms of a loan, a person will need to provide the borrower with a credit institution documents confirming his residence at the place of registration at the time of the emergency. The borrower must also be included in the list of victims of the emergency.
