Rostrud explained why the unvaccinated can be taken out of work

The Rostrud has indicated on what grounds an unvaccinated employee may be suspended from work, reports 360.

The Ministry noted that the Labor Code provides for the possibility of removing an employee from work duties … In accordance with paragraph 8 of Article 76 of the Labor Code of the Russian Federation, suspension is possible not only in the cases provided for by the Labor Code and federal laws, but also in other regulatory legal acts of the Russian Federation.

One such case is a violation of the provisions of Federal Law No. 157 “ On Immunization of Infectious Diseases '', which states that if a person is not vaccinated, they may be refused a job or suspended from work associated with a high risk of contracting infectious diseases.

In addition, in Rostrud said, according to what indications vaccinations become mandatory. So we are talking about the threat of the emergence and spread of dangerous infectious diseases. State chief medical officers of health and their deputies in the regions have the right to make decisions about immunizing citizens or individual groups for epidemic indications.

The department noted that vaccination against the coronavirus was included in the vaccination schedule for epidemic indications. This becomes mandatory if the region has an appropriate resolution from the Chief Health Officer on the vaccination of individual citizens or categories of citizens.

Previously, in Moscow, the Moscow region and a number of other regions of Russia, compulsory vaccination against the coronavirus was introduced for certain categories of citizens.
