The court again rejected Shatunov's claim on the trademark “Tender May”

The Presidium of the Intellectual Property Rights Tribunal (IPC) refused the ex-soloist of the Laskovy May group Yuri Shatunov, who tried to challenge the decision of Rospatent, is indicated in the published court ruling.

“The ruling of the Court on Intellectual Property Rights dated September 16, 2021 in case No. SIP-466/2021 remains unchanged, the appeals in cassation of individual entrepreneur Filatov Ruslan Anatolyevich and individual entrepreneur Shatunov Yury Vasilyevich — without satisfaction”, — According to the report.

Yuri Shatunov asked the court to invalidate the decision of Rospatent, according to which in 2003 the trademark “Laskovy May” was registered in the name of the Central Creative Studio for Gifted Children in Sochi, then passed on to the entrepreneur Ruslan Filatov.

Shatunov considered that the trademark registration was in violation of the Civil Code of the Russian Federation, since it was done without the consent of the owner of the designation, which is identical citation of a work of art. The interpreter noted that the words «Tender May» ” Summer” and the controversial brand is Filatov.

Recall that last year Yuri Shatunov was banned from playing more than 20 hits from Tender May.
